1. Ticketing and Wristbands
1.1 Riverboats Music Festival (“the Event”) tickets are sold and issued by Ticket Solutions Pty Ltd (ACN 106 907 206) trading as Oztix as agent for Riverboats Music Pty Ltd (ACN 111 322 180) (“Us”, “We” or “Our”) on these terms and conditions.
1.2 Tickets are refundable or exchangeable only in accordance with these terms and conditions or as otherwise required by law.
1.3 We may cancel any quantity of tickets purchased by a buyer above any published limit on the quantity of tickets that may be purchased by a buyer. If We do so, We will refund the amount paid for the cancelled tickets.
1.4 A unique QR Code is associated with and printed or displayed on each individual ticket issued.
1.5 At the gate, each bearer of a QR Code associated with a valid ticket to the Event which has not previously been presented will be fitted with a wristband. The wristband entitles the wearer to attend the Event or, in the case of a single-day ticket, the relevant day of the Event, subject to these terms and conditions.
1.6 Because wristbands are issued upon presentation of a valid QR Code, ticket buyers are responsible for taking reasonable care to prevent the QR Code associated with each ticket from being copied or used by another person. In particular, ticket buyers should not post photographs or other images of their tickets or QR Codes on social media or otherwise make them publicly available.
1.7 If the same QR Code is presented more than once, We may refuse to issue a further wristband unless We are reasonably satisfied that the earlier presentation resulted from fraud, error or other circumstances not caused or contributed to by the ticket holder. Nothing in this clause limits any right or remedy arising where the duplication or unauthorised use resulted from an act or omission of Us or Oztix.
1.8 Attendees must wear a valid wristband at all times during the Event. Weekend attendees must therefore keep their wristbands on overnight on Friday and Saturday.
1.9 Wristbands may not be transferred.
1.10 Except as required by law, no refund or exchange is available in respect of a wristband that is lost or stolen.
1.11 A damaged wristband may be exchanged where the wearer provides reasonable evidence of their entitlement to attend, including the QR Code presented when the wristband was issued and identification corresponding with the ticket buyer. A person who acquired their ticket through Our official ticket resale partner may instead produce reasonable evidence of that authorised transfer.
1.12 Wristbands remain Our property until the conclusion of the Event, at which time ownership of them passes to their wearers.
1.13 A person's entitlement to attend the Event is a licence. We may revoke that licence and require the person to leave the Event if the person:
a) materially breaches these terms and conditions;
b) engages in conduct which reasonably presents a risk to the safety or security of any person;
c) fails to comply with a reasonable direction given by Us, Our staff or security personnel in connection with the safe and orderly conduct of the Event.
1.14 Any decision to revoke a person's licence must be reasonable having regard to the nature and seriousness of the relevant conduct. Except as otherwise required by law, no refund will be payable where a person's licence is revoked because of their own conduct.
1.15 An attendee must produce their wristband for inspection on request and, where reasonably required to verify their entitlement to attend the Event, their ticket, QR Code or other reasonable evidence of that entitlement.
1.16 A person who purchases tickets on behalf of other attendees must make these terms and conditions known to those attendees.
1.17 Entry to and continued attendance at the Event is subject to compliance with these terms and conditions.
2. The Event
2.1 The Event is the Riverboats Music Festival held at Aquatic Reserve in Echuca, during which performing artists provide live entertainment and related festival activities.
2.2 If Aquatic Reserve becomes unavailable or unsuitable for the Event, We may move the Event to another venue reasonably selected by Us having regard to the circumstances. We will give ticket holders reasonable notice of any change of venue where practicable.
2.3 We may make reasonable changes to the Event program where circumstances require, including changing performance times or adding, withdrawing or substituting artists.
2.4 The Event is an outdoor summer event. We may alter the time of commencement of the first performance and the time of conclusion of the last performance if We reasonably consider it appropriate to do so because of forecast or actual weather conditions or any concern relating to safety or attendee welfare. We may also make corresponding changes to the Event admission times.
2.5 We may also, for any of those reasons, change the timing or running order of performances, shorten individual performances and introduce a continuous break in performances of up to one third of the period between the commencement of the first performance and the conclusion of the last performance for that day, including where those times have been altered under clause 2.4.
2.6 Where We make changes under clauses 2.4 or 2.5, We will use reasonable endeavours to maintain the scheduled program of performing artists, although the timing and duration of individual performances may be altered or abbreviated.
2.7 A change made in accordance with clauses 2.4 or 2.5 does not, merely because of that change, constitute a cancellation, interruption or postponement of the Event or any part of it for the purposes of clause 3 or entitle a ticket holder to a refund, credit or compensation under these terms and conditions.
2.8 Where practicable, We will give ticket holders reasonable notice of any significant change to the Event program.
2.9 A change to the Event program which does not materially alter the Event does not, of itself, entitle a ticket holder to a refund or compensation.
2.10 The Event may proceed rain, hail or shine, subject always to safety considerations and applicable law.
2.11 Nothing in this clause limits any right or remedy a ticket holder may have under the Australian Consumer Law or any other applicable law.
3. Cancellation, Interruption and Postponement
3.1 In this part, a period of cancellation means a period during which:
a) patrons are not permitted to enter or remain in the Event venue; or
b) substantially all scheduled Event programming for that period is cancelled or suspended -
but does not include a break or other alteration to the Event program made in accordance with clauses 2.4 or 2.5.
3.2 The cancellation, withdrawal or substitution of an individual artist does not, by itself, constitute a period of cancellation for the purposes of this clause.
3.3 If any period of the Event is cancelled, ticket buyers will be entitled to the following contractual refunds. For this purpose, each of Friday, Saturday and Sunday are referred to as a “day” of the Event.
a) In respect of any whole day of the Event that is cancelled:
i. the price of any single-day ticket for that day will be refunded; and
ii. 30% of the price of any weekend ticket will be refunded if the affected day is Friday or Sunday;
iii. 40% of the price of any weekend ticket will be refunded if the affected day is Saturday.
b) If one or more periods of cancellation affect less than a whole day, We will calculate the percentage of that day’s total scheduled performance time lost because of those cancellations, in accordance with clause 3.4:
i. buyers of single-day tickets for that day will receive a refund of that percentage of their ticket price; and
ii. buyers of weekend tickets will receive a refund of that percentage of the affected day’s share of their ticket price. Friday and Sunday each account for 30% of the weekend ticket price, and Saturday accounts for 40% -
(For example: If half of Saturday’s scheduled performance time is lost, buyers of Saturday tickets will receive a 50% refund. Buyers of weekend tickets will receive a 20% refund—half of Saturday’s 40% share of the weekend ticket price.)
3.4 For the purposes of clause 3.3:
a) scheduled performance time means the combined scheduled duration of the individual performances for the relevant day, excluding all breaks between performances;
b) the calculation is based on the published program applying immediately before the first period of cancellation on that day, but subject to any changes already made in accordance with clauses 2.4 or 2.5. Performances affected by the cancellation remain included in the total scheduled performance time for that day;
c) performance time is counted as lost only to the extent that it is affected by a period of cancellation and is not made up later that day; and
d) changes made in accordance with clauses 2.4 or 2.5, including the shortening of performances or introduction of a break made in accordance with those clauses, are not counted as lost performance time.
3.5 The refunds provided for by clause 3.3 are contractual entitlements and do not limit any greater refund, compensation or other remedy to which a ticket buyer may be entitled under the Australian Consumer Law or any other applicable law.
3.6 If the Event or any day of the Event is postponed or rescheduled rather than cancelled, We may make the relevant ticket valid for the rescheduled date. We will notify affected ticket buyers of the arrangements as soon as reasonably practicable. Nothing in this clause limits any right a ticket buyer may have to a refund or other remedy under applicable law.
4. Paddlesteamer Sideshows
4.1 Purchasers of Riverboats Paddlesteamer Sideshow tickets must pay particular attention to the advertised departure time.
4.2 Except as otherwise required by law, a refund will not be available merely because a ticket holder arrives too late to board a paddlesteamer that departed at its advertised or otherwise properly notified departure time.
5. Resale of Tickets
5.1 Tickets may be resold for no more than their original sale price.
5.2 If We are reasonably satisfied that a ticket has been offered for resale or resold at a price higher than its original sale price, or otherwise in breach of applicable ticket resale laws, We may cancel the ticket to the extent permitted by law. Where reasonably practicable, We will consider evidence of the price paid or the circumstances of the resale before doing so.
5.3 We encourage ticket holders wishing to resell tickets to do so through the Event's official ticket resale partner, Tixel.
5.4 We are not responsible for private transactions or ticket exchanges arranged between individuals. Buyers and sellers using private resale arrangements are responsible for satisfying themselves as to the validity of the ticket and the satisfactory completion of the transaction, subject to any rights they may have under applicable law.
5.5 A buyer who acquires a ticket through the Event's official ticket resale partner should retain evidence of the authorised transfer. That evidence may be required if We need to verify the buyer's entitlement to attend or replace a damaged wristband.
5.6 A buyer of a ticket from a reseller other than the Event's official ticket resale partner may have difficulty satisfying the requirements for replacement of wristbands described at clause 1.11.
6. Lost Stolen or Damaged Tickets
6.1 If you purchased a ticket online through Oztix and have lost the email sent to you at the time of purchase, please contact Oztix at info@oztix.com.au.
6.2 If a ticket or QR Code is lost, stolen or you reasonably believe that it has been copied or compromised, you should contact Oztix as soon as practicable. We cannot guarantee replacement or admission where a valid QR Code has already been used, subject always to these terms and conditions and any rights arising under applicable law.
7. Youth Policy
7.1 The Event venue is a licensed venue.
7.2 Proof of age is required upon presentation of a Youth Ticket QR Code for a wristband. A Youth Ticket is for a person who is under 18 years of age on the last day of the Event.
7.3 An attendee under 18 years of age must be accompanied by a responsible parent or adult guardian who also holds and wears a valid wristband. The parent or adult guardian must remain responsible for and accompany the young person while at the Event.
7.4 We strongly recommend that the accompanying parent or adult guardian be aged 25 years or older.
7.5 Persons aged 5 years and over must purchase a ticket to the Event.
7.6 Children under 5 years of age will be admitted free of charge but must at all times wear a wristband bearing the name and mobile phone number of their accompanying parent or adult guardian.
8. Conditions of Entry and Attendance
8.1 Attendees must:
a) comply with all applicable laws while attending the Event;
b) comply with reasonable directions given by Our staff and security personnel and with lawful directions given by police;
c) permit Our security personnel to inspect bags and personal property where reasonably required for safety and security as a condition of entry or continued attendance, and comply with any lawful search or other requirement imposed by police;
d) produce proof of age on request by Our staff, security personnel or police where reasonably required;
e) use designated walkways and paths and comply with Event safety signage and reasonable safety directions; and
f) wear footwear at all times.
8.2 Attendees must not:
a) be intoxicated or adversely affected by illegal drugs;
b) bring or attempt to bring into the Event alcohol, illegal drugs, weapons or any item reasonably considered by Us or Our security personnel to present a safety or security risk;
c) consume alcohol supplied at the Event outside the area in which its consumption is permitted;
d) bring any pet or other animal into the Event, other than an assistance animal;
e) behave in a dangerous, violent, threatening, seriously disruptive or offensive manner, or in a manner which unreasonably interferes with the safety or enjoyment of other attendees;
f) audio or video record, livestream or otherwise transmit any performance without Our written permission, except to the extent expressly permitted by Us at the Event;
g) bring or attempt to bring professional audio or video recording equipment into the Event without Our written permission; or
h) enter or attempt to enter any backstage, production or other restricted area without authorisation.
8.3 Attendees may bring their own food into the Event.
8.4 Attendees acknowledge that photography and filming take place at the Event and that attendees may appear in photographs or recordings of the Event.
8.5 We may use photographs and recordings made by Us or persons authorised by Us for the purposes of documenting, reporting on, archiving and promoting the Event and future Riverboats Music Festivals, including through Our websites, social media and promotional materials.
8.6 We will not use an identifiable attendee's image in a manner which falsely represents that the attendee endorses a product, service or organisation.
8.7 A parent or guardian accompanying a child acknowledges that the child may incidentally appear in photographs or recordings made at the Event.
8.8 Nothing in this clause limits any right arising under applicable privacy or other law.
9. Safety and Liability
9.1 The Event is conducted in a natural outdoor environment and attendance involves risks of which attendees should be aware.
9.2 Those risks include waterbodies; uneven, steep or slippery ground; holes and other ground hazards; poor visibility after sunset; falling tree limbs; wind and airborne objects; high temperatures and exposure to the sun; rain and other adverse weather; loud noise; and crowded areas.
9.3 Some areas may become particularly crowded with attendees who are dancing or moshing, which may increase the risk of accidental contact, falls or injury.
9.4 Attendees must exercise reasonable care for their own safety and the safety of others, move carefully around the venue and have regard to weather conditions, crowd conditions, signage and directions given by Event staff.
9.5 Nothing in these terms and conditions excludes, restricts or modifies any consumer guarantee, right, remedy or liability which cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
9.6 Subject to clause 9.5, each attendee accepts the ordinary and obvious risks associated with attending an outdoor music festival and is responsible for taking reasonable precautions having regard to those risks.
9.7 Nothing in this clause makes an attendee responsible for loss, damage or injury to the extent it is caused or contributed to by Our failure to comply with an obligation which We owe under applicable law.
9.8 Attendees are responsible for taking reasonable care of their own personal property while at the Event.
9.9 To the extent permitted by law, We are not responsible for loss of or damage to personal property resulting from an attendee's own act or omission or the act of another attendee or third party for whom We are not legally responsible.
10. Privacy
10.1 We may collect, use and retain personal information provided by ticket buyers and attendees where reasonably necessary for ticketing, administering and operating the Event, communicating important Event information, responding to enquiries, managing safety and security and complying with Our legal obligations.
10.2 Personal information may be provided to Oztix, Our official ticket resale partner and Our contractors and service providers where reasonably necessary for those purposes, and to government agencies, emergency services or other authorities where required or authorised by law.
10.3 We will not sell or trade personal information.
10.4 Where We send commercial electronic messages, We will do so only with the consent required by law and will provide recipients with a means of unsubscribing in accordance with applicable law.
10.5 Nothing in this clause limits any rights which a ticket buyer or attendee has under applicable privacy law.
11. Sideshow Services
11.1 These terms and conditions apply, to the extent that may be applicable, in respect of the separately ticketed activities aboard the PS Pevensey (operated by the Port of Echuca), being part of the festival's sideshow series.
